    Terms of Service

    The Gist

    Cramd operates the CramdApp service, and we appreciate your responsible use of it. To maintain a positive user experience, we reserve the right to terminate your account if the service is misused. Monthly/yearly charges apply to paid accounts, with the flexibility to cancel anytime.

    Before utilizing any of our services, it is crucial to read the complete Terms of Service and agree to its details.


    1. Eligibility & Age Requirements

    Cramd is designed to help students study, but it is not intended for use by children under the age of 13. By accessing or using the Service, you represent and warrant that you are at least 13 years of age. If you are under the age of 18, you must review these Terms with your parent or legal guardian to ensure that both you and your parent or guardian understand and agree to these Terms.

    2. Your Account

    • Human Creation: Accounts must be created by a human. Automated methods, bots, or script-based creations are strictly prohibited.
    • Registration Accuracy: You must provide accurate, complete, and current information when creating an account.
    • Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify Cramd immediately of any unauthorized use or security breach of your account.

    3. Use of the Service & Acceptable Use Policy

    Compliance with all applicable laws, regulations, and ordinances is mandatory. To protect our users and the platform, you agree not to:

    • Infringement: Upload or share any content that violates, infringes, or misappropriates any third-party intellectual property, privacy, or publicity rights.
    • Illegal Content: Upload, store, or transmit any content that is illegal, defamatory, harmful, abusive, harassing, or otherwise objectionable.
    • Scraping & Automated Abuse: Scrape, crawl, extract, or index any part of the Service using automated means, bots, spiders, or scrapers.
    • Security & Overloading: Attempt to bypass, disable, or circumvent any security measures, or attempt to overload, crash, or interfere with our servers and platform infrastructure (e.g., Denial of Service attacks).
    • Reverse Engineering: Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software powering the Service.
    • Credential & Account Abuse: Share account credentials or access details with unauthorized parties, or attempt to gain unauthorized access to other users' accounts.
    • Malware: Distribute viruses, malware, trojan horses, or other malicious code.

    4. Service Availability & Modification Disclaimer

    • No Uptime Guarantee: While we strive to make the Service available consistently, we do not guarantee uninterrupted uptime or availability.
    • Service Changes: The Service may change, be updated, or evolve without prior notice. We reserve the right to modify the Service, which includes removing features, changing usage/resource quotas, changing AI models, or experiencing temporary downtime for maintenance or upgrades.
    • No Liability for Modification: Cramd is not liable to you or any third party for modifications, price changes, feature removals, or temporary/permanent suspension of the Service.

    5. Intellectual Property

    • Cramd Platform IP: All rights, title, and interest in and to the Service, including the platform design, software, codebase, logos, graphics, and proprietary study tools (excluding user-uploaded content) are and will remain the exclusive property of Cramd.
    • Generated Outputs: Subject to your compliance with these Terms, Cramd grants you a non-exclusive, non-transferable, revocable license to use the study aids, flashcards, quizzes, active recall questions, and summaries generated by the Service (collectively, "Generated Outputs") for your personal, non-commercial educational purposes.
    • Ownership of User Uploads: As between you and Cramd, you retain all intellectual property rights and ownership in the documents, notes, PDFs, images, and other study materials you upload to the Service ("User Content").

    6. User Content Rights & License

    By uploading User Content (including PDFs, notes, images, study materials, and flashcards) to the Service, you grant Cramd a worldwide, limited, non-exclusive, royalty-free, sublicensable (solely to our infrastructure partners and service providers), and fully paid license to host, store, process, reproduce, modify, translate, analyze, and display such content. This license is granted solely for the purpose of operating, improving, providing, and developing the Service (such as generating study materials, storing files, and displaying them back to you).

    7. AI Disclaimer & Educational Reliance

    To provide automated study aids, flashcards, and quizzes, Cramd utilizes advanced artificial intelligence technology.

    • Inaccuracies & Hallucinations: AI-generated outputs, study materials, and answers are generated automatically and may contain inaccuracies, hallucinations, incomplete information, or errors.
    • No Academic or Professional Guarantee: Cramd is designed to assist students studying for high school, college, pre-med, the MCAT, and other exams, but we make no guarantees regarding academic performance or exam results.
    • User Responsibility: You are solely responsible for independently reviewing, verifying, and validating AI-generated study materials and outputs before relying on them academically, professionally, or otherwise.

    8. Fees, Subscriptions, & Billing Clarity

    • Paid Subscriptions: Certain resources and features on Cramd require a paid subscription. Prices and features are detailed on our pricing page.
    • Recurring Billing & Auto-Renewal: By subscribing to a paid plan, you authorize Cramd (via our payment processor, Stripe) to charge the applicable subscription fees on a recurring monthly or annual basis. Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
    • Cancellation Timing: You can cancel your subscription at any time via your account settings page. Cancellation will take effect at the end of the current billing cycle, and you will retain access to the paid features until then.
    • Refund Limitations: Except as required by law, all fees are non-refundable. We do not offer refunds, credits, or prorated billing for partial subscription months or unused credits.
    • Taxes: All fees are exclusive of applicable taxes, which you are responsible for paying.
    • Price Changes: Cramd reserves the right to adjust subscription pricing. Any price changes will be communicated in advance, and continued use of the Service after the change constitutes acceptance.

    9. Cancellation & Termination

    • User Cancellation: You can cancel your account at any time. Upon cancellation, your customer info and uploaded content will be deleted in accordance with our Privacy Policy.
    • Termination by Cramd: We reserve the right to terminate, suspend, or restrict your account and access to the Service at our sole discretion, without prior notice or liability, for reasons including but not limited to:
      • Material violations of these Terms.
      • Fraudulent, abusive, or illegal conduct.
      • Attempts to disrupt or overload the platform.
      • Non-payment of subscription fees.

    10. Limitation of Liability & Warranty Disclaimer

    • "As Is" Basis: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CRAMD DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
    • Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, CRAMD, ITS AFFILIATES, AND ITS PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY.
    • Liability Cap: IN NO EVENT SHALL CRAMD’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00) OR THE TOTAL AMOUNT PAID BY YOU TO CRAMD FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

    11. External Resources & Links

    The Service may include hyperlinks to external content, sites, or resources. Cramd is not responsible for the availability, privacy practices, or endorsement of such external sites or resources.
